Job Purpose

The Cluster Tax & Regulatory Lead will be responsible for providing Tax compliance and support Corp /SSC Tax teams for Direct and Indirect Taxes, providing Audit support and ICFR control and also in ensuring full compliance of regulatory matters for Cluster/Circle including AGR assessment and regulatory payments. Timely submission of monthly, quarterly and annual returns, appearance before the authority concerned and arranging for submission of suitable reply in coordination with Corporate tax team/SSC/Tax consultant. The profile calls for the Jobholder to maintain effective and continuous liaison and co-ordination with different hierarchical levels in DoT and BSNL and also with non-Circle internal stakeholders

Key Result Areas/Accountabilities

Tax KRAs

• Coordinating for Filing monthly and Annual returns under GST and local tax laws
• Ensuring all eligible input credit are availed by means of various control vis-a-vis reconciliation of input GL/ GSTR2A with Purchase Register etc.
• Attending the department as an when required and submit details called upon, drafting and submission of reply for notices in consultation with Corporate/SSC/Consultant
• Attending various queries raised by channel/distributors/vendors.
• Maintaining various control mechanism to ensure that tax liability is correctly discharged.
• Monitoring E-way bill data and ensuring that there are least possibility of detention of vehicle for non-compliance to the Act in coordination with Commercial Team

• Coordination for Filing of quarterly TDS returns and supporting in reduction of TDS demands related to 26AS system
• Supporting to complete IT assessment and corporate litigation at corporate level by providing relevant circle data

• Attending the State VAT and GST assessment/SCN’s/investigations before the department for both brands and to make submission in consultation with tax team at corporate and consultant.
• Ensure that state VAT and GST assessment is complete without demands
• Collect all statutory forms on concessional rate of tax viz, F Forms/C forms and ensure nil demand.

• Attending before the authority as and when required and to submit reply in consultation with corporate team.
• Help in working on amnesty scheme from relevant state Governments
• Ensuring getting stays from tax authorities for various demand notices as per relevant rules with minimum cash outflow
• Coordination with banks for any attachment of accounts by tax authorities for related tax demands
• Attending to the various audit team and to ensure to have nil or minimum qualification in the audit report.
• Completion of Tran1 credit return audit without nil/minimum disallowance

• Attending before the Customs authority on various notices issued by them for short payment of customs duty and to submit details/reply.
• Filing of refund claim on duty paid under protest against various notifications (Pre-GST).
• Tracking and management of all Tax related litigations by proper liaising with Corporate, SSC and Tax consultants.
• Working on various tax projects related to taxation
• Support in various audits like tax audit, transfer pricing audit, GST audit, statutory audit and ICFR controls and reporting’s

Regulatory KRAs

• Directing and ensuring Filing of Quarterly & Annual Returns with DoT along with all back up documentary proof required for assessment
• Ensuring timely completion of the quarterly AGR assessment with NIL exposure by regular visits to DoT office and explaining and correlating the backup documentation (including various certifications – AO, AG & IR - by Statutory Auditors) with returns filed.
• Ensuring Timely and proper appeal action taken – formal as well as informal – to higher DoT authorities against disallowances not justified by regulations.
• Provide timely feedback/inputs to Corporate Regulatory Finance for  support and guidance for matters requiring appeal/liaising at DoT HQ and/or Industry level
• Avoid financial exposure by way of interest/penalty by ensuring that periodical regulatory payments by Circle are accounted for by DoT in proper and timely manner.
• Avoid blockage of non-funded bank finance limits by ensuring correct level of Bank Guarantees (BGs) with DoT and co-ordinate with Corporate Treasury for timely renewal and replacement of BGs to avoid encashment.
• Liaising with. BSNL for any Circle matters related to regulatory finance.
• Check Circle revenue under different segments and ensure correct representation the same in returns and availability of reconciliation of the same with Business reporting
• Ensuring ASR completion and AGR audit related co-ordination for circle documents

Core Competencies, Knowledge, Experience

1. Min 10 year work experience related to Tax & Regulatory, preferably in Telecom
2. Good understanding of the Telecom Regulations governing AGR Computation and assessment and  other regulatory financial matters
3. Good understanding of Telecom revenue accounting especially of those revenue components specifically governed by regulations and judicial pronouncements and the presentation of the revenue components in Quarterly & Annual Returns filed with DoT
4. Should have up to date knowledge on Tax related matters / notifications.
5. Working Knowledge SAP system , Excel & HPM/HFM
6. Business acumen and understanding of macro / biz drivers
